What’s the state of ADA compliant doors today? We asked this question to more than 700 ADA consultant specialists throughout the U.S. Here’s what they had to say. Progress…But There’s Still Work to DoIt appears that some of the problems that existed in 1990 with accessible doors and hardware still exist today. However, for the most part, door hardware companies understand ADA and are designing and specifying compliant hardware for the commercial marketplace. That said, there is still a need for innovation and improvement in some areas. Among the multitude of responses we gathered, common concerns emerged, along with some interesting and identifiable trends. *….One of the areas where improper ADA door hardware is most apparent is in existing facilities. Mark Felling of Broadened Horizons, Inc. of Minnesota states, “I run across doors with two- or even three-inch thresholds weekly, especially with small businesses that think it is not a big deal or that their facility is accessible because [the step into the facility] is not a full-size step. But in reality, they are actually in violation of the ADA and are keeping potential customers out. I cannot count how many times I have been told [incorrectly] that they are grandfathered or are too small for the ADA to apply to them.” We found this sentiment common among the responses from the group of consultants we polled. While the professionals in this industry understand that there is no “grandfather” clause that allows for non-compliance of ADA for any business, it is nonetheless a common held belief by many business owners that they are somehow exempt from ADA compliance at their doors. This has resulted in the annual filing of thousands of ADA litigation cases throughout the United States, putting business owners at serious risk of monetary losses. Chris Taylor of ADA Compliance Consultants of California explains: “Typical litigation will range any-where from $4,000 to $30,000, prior to any mitigation efforts for barrier removal. Civil penalties may run as high as $55,000 for a first violation or $110,000 for a subsequent violation.” For large companies, these fines may be more annoying than punitive, but for smaller companies, they can add up quickly. Even for larger operations, the cumulative effect of multiple violations can be damaging. And ignorance of the law is never considered a reasonable excuse. Dennis Hytinen, President of CASp Solutions in California, states, “Many of our clients rush to the big box stores to buy their doorknobs, only to find out that the package that says ‘ADA Compliant’ doesn’t actually meet the state regulations. I see lawsuits weekly against property owners and tenants over access, and soon I think some of the blame will be shifted to designers, contractors, suppliers and manufacturers.” Many of the ADA consultant specialists we surveyed are involved in everyday ADA litigation and provide expert testimony at federal and state trial courts. The complexity of code interpretation has created an entire new industry of inspection professionals who are hired to interpret various complex code regulations. Naturally, the type of facility, when it was constructed, and its use are just some of the considerations when applying the proper access laws and regulations. Additionally, some state building codes can be more restrictive than ADA on the national level. According to Mike Miyaki, CASp, of Kim R Blackseth Interests, Inc. of California, “We have done thousands of site surveys for commercial and Figure 303.2retail facilities. The main issues we find with existing door entrances are hardware (no grasping, pinching or twisting of the wrist is permitted), landings (slope issues at either the push side or pull side of the entry door), thresholds (greater than 1/2″ high, beveled) and door stops (or kick stops mounted on the bottom of the door).” This is consistent with the responses to our survey. The most common violations listed were door threshold height issues, proper strike-side clearance, door pressure and door clearances. Thresholds and Changes in Elevation for ADA Compliant DoorsAccording to Dennis Hytinen, “Abrupt changes in elevation at thresholds and out-of-level door landings are present in 80 percent of the commercial properties we survey.” This is a violation of ADA regulations. When it comes to changes in the level of the floor surface, ADA 2010 Standards 303.2 and 303.3 state: “Changes in level of ¼ inch (6.4 mm) high maximum shall be permitted to be vertical.” In addition, “Changes in level between ¼ inch (6.4 mm) high minimum and ½ inch (13 mm) high maximum shall be beveled with a slope not steeper than 1:2.” However, 404.2.5 does allow for “existing or altered thresholds 3/4 inch (19 mm) high maximum that have a beveled edge on each side with a slope not steeper than 1:2.” Often contractors are required to purchase aftermarket products such as modular ramps or landings to bring new and existing door products into compliance. In the new 2010 ADA standards, sliding glass doors are required to meet the ½” vertical rise requirement, whereas under the old standards, a ¾” threshold height was allowable. ADA Tax Credit The tax credit, established under Section 44 of the Internal Revenue Code, was created in 1990 specifically to help small businesses cover ADA-related “eligible access expenditures. ” A business that for the previous tax year had either revenues of $1,000,000 or less or 30 or fewer full-time workers may take advantage of this credit. The credit can be used to cover a variety of expenditures, including:provision of readers for customers or employees with visual disabilities provision of sign language interpreterspurchase of adaptive equipment production of accessible formats of printed materials (i.e., braille, large print, audio tape, computer diskette) removal of architectural barriers in facilities or vehicles (alterations must complywith applicable accessibility standards) fees for consulting services (under certain circumstances). Note that the credit cannot be used for the costs of new construction. It can be used only for adaptations to existing facilities that are required to comply with the ADA. The amount of the tax credit is equal to 50% of the eligible access expenditures in a year, up to a maximum expenditure of $10,250. There is no credit for the first $250 of expenditures. The maximum tax credit, therefore, is $5,000. Tax Deduction The tax deduction, established under Section 190 of the Internal Revenue Code, is now a maximum of $15,000 per year—a reduction from the $35,000 that was available through December 31, 1990. A business (includingactive ownership of an apartment building) of any size may use this deduction for the removal of architectural or transportation barriers. The renovations under Section 190 must comply with applicable accessibility standards.Small businesses can use these incentives in combination if the expenditures incurred qualify under both Section 44 and Section 190. For example, a small business that spends $20,000 for access adaptations may take a taxcredit of $5000 (based on $10,250 of expenditures), and a deduction of $15,000. Sometimes, I can look at something like that and assume that the person filing the lawsuit overreacted. Now imagine you were in a car accident later today. You are now paralyzed from the waist down, and you will never be able to walk again. After a lengthy recovery time in the hospital, you sit in a wheelchair for the very first time and realize that your life will never be the same. You’ll never be able to kick a soccer ball with your kids, run a marathon, or hike that section of the Pacific Crest Trail you always wanted to. So you learn to push your own wheelchair everywhere in order to be as independent as possible. You insist on it, all the time. One day you visit a restaurant with your family, and there is a 2-inch ledge on the doorway that you don’t see. Not expecting the ledge, you hit it very hard, and suddenly you’ve fallen from your chair and hit your head. The embarrassment alone is enough to seriously upset you, but you’ve also got a huge lump on your head, not to mention the pitying glances of everyone around you. It could happen to any of us. That’s what ADA is about. It’s not just about a building code, or even only about serious accidents. Just because someone wasn’t seriously injured doesn’t mean that they couldn’t have been. It’s a civil rights law, and it means that no matter if you’re in a wheelchair, have a walker, or have any other mobility issue, you should be able to get around safely. You shouldn’t have to over-prepare for every outing, or wear kneepads in case you fall from your wheelchair. It’s not an overreaction to demand a safe path of travel so that you don’t injure yourself while doing normal daily activities. This is an issue of everyone having the same rights, the same access to public places. It’s not necessary to have a relative or close friend in a wheelchair to understand that this is an issue either. Still, it doesn’t hurt to imagine yourself in someone else’s shoes. Try to understand the struggles they go through every day, simply with getting around the way you are able to all the time. ADA is a civil rights issue, and it was passed in 1990, and enacted in 1992. If your building was built after 1991, it should already be up to code. Imagine turning carpet waste and old tires into new consumer products instead of piling up in landfills. The Landfill Crisis: Waste Tires and Carpet in California Waste carpet and used tires are two of the biggest contributors to growing landfills. How can manufacturers create new products while repurposing these materials consumer use? The issue is real, and very big.  There are over 61 million adults in the United States living with disabilities – 1 out of every 4Americans.  This segment of our population also has sizable discretionary buying power of over $175 billion dollars.  These numbers will continue to grow as our population ages, with the number of adults age 65 and over projected to double by the year 2030. Removal of DHI Complex Barriers Under ADA Regulations To assist owners and facility managers in complying with the ADA for existing facilities, there are a set principals or priorities established in 28 CFR Part 36, Section 36.304(c) (1)(Removal of Barriers) of the ADA. https://www.ada.gov/reg3a.html#Anchor-91481 The goal is to afford every individual the opportunity to benefit from our country’s businesses and services, and to afford our businesses and services the opportunity to benefit from the patronage of all Americans.  To do so, access must be provided to entryways on the path of travel from the parking lot into facilities and rooms where your products and services are provided. A good starting point is to make improvements to the location in your facility that provides the greatest degree of access for most people.  Following this concept is helpful in prioritizing and providing a starting point for barrier removal. Facility owners and managers are often then faced with the dilemma of having to modify buildings, sometimes of antiquated architectural design, under the sometimes conflicting, or at least confusing, statutory language of the ADA.  Local and state building codes, some of which are in concert with the ADA and some of which are not, must also be considered when deciding the most appropriate ways to remove barriers. ADA Standards for Accessible Design (2010 ADAS) Fortunately, the adoption of the 2010 ADA Standards for Accessible Design (2010 ADAS) – which took effect throughout the United States in March 2012 – provided many clarifications and improvements to the regulations.  This was the first major update to the 1990 ADA Standards, and many states followed suit. In it the ADA distinguishes between the standards of compliance for new construction, additions and simple barrier removal for existing facilities.  New construction must incorporate accessibility by design, construction methods and products used.  Unfortunately, mistakes are made, and retrofit accessibility products can sometimes provide solutions.  Altered facilities must also comply with new construction standards to the maximum extent feasible, and retrofit products are frequently used.  All newly constructed or altered areas of facilities, either commercial or public, must be made accessible. When the alteration goes beyond simple barrier removal and involves remodeling or renovation, different rules for barrier removal apply.  Depending upon the extent of the alteration and the functional area modified and the usability of that area, different standards or burdens, to the extent of accessibility modifications required, may be placed on the building’s owner.  For existing facilities, the ADA “requires the removal of architectural barriers…that are structural in nature…where such removal is readily achievable, i.e., easily accomplishable, and able to be carried out without much difficulty or expense.” ADA Doorway Threshold Challenges This brings us to one of the more difficult problems presented by existing buildings:  door thresholds that are too high to comply with the 2010 ADA standards.  Everyone agrees that threshold height can be a significant barrier to someone in a wheelchair or with another form of disability, but removing that barrier can be very difficult.  A common and cost-effective solution is the construction of an ADA level landing or using a ramp with a maximum slope of 1:12 (one inch of vertical rise for every 12 inches of horizontal length).  https://safepathproducts.com/products/ Ramp and Level Landing Solutions Very simply, it is desirable for a person in a wheelchair to be on a level surface when opening a door, or to be able to manage a wheelchair on a slope that is not too steep.  Fortunately, the height of most thresholds that are out of compliance allow for modular level landing systems which can maintain existing slope and allow a person in a wheelchair to approach and open a door on a level maneuverable surface area.  In these instances, it’s important to specify the side approach to these landings and be mindful that the cross slope be no greater than 2%.  Interpreting the 2010 ADA while considering local building codes is not always easy and often demands interpretation, especially when you are trying to determine the best alternative to a difficult situation. Clearly, the major impact of the ADA is on existing facilities.  As stated in 2010 ADAS Section 202.3.1 Prohibited Reduction in Access: An alteration that decreases or has the effect of decreasing the accessibility of a building or facility below the requirements for new construction at the time of the alteration is prohibited.  Although the ADA encourages “readily achievable” solutions to existing problems, once alterations for barrier removal has been initiated, all work must comply with the 2010 ADAS as for new construction and cannot be a reduction of access. - [ADA Non-Compliance and the Door Threshold](https://safepathproducts.com/ada-non-compliance-and-the-door-threshold/): Thousands of our school campuses across the country that were constructed over 10 to 15+ years ago are absent the door threshold design considerations set forth by the Americans with Disabilities Act (ADA). As a result, a large percentage of school facilities and classrooms built prior to 1992 are still not ADA compliant with state, local, and federal building codes, and are therefore vulnerable to multiple code violations if inspected. In this article we will focus on the most prevalent instance of non-compliance – door thresholds. In order to be ADA compliant, existing door thresholds are required to have a vertical height no greater than ¼”. However, a vertical height of up to ¾” is allowed if a transition ramp is applied. If the door threshold is higher than ¾” then an associated level-landing is required. What is a level-landing? A level-landing is the code-mandated solution for a threshold modification made to existing doorways with door threshold heights greater than ¾”. Traditional solutions have included saw cutting, jack-hammering, abrading and pouring a built up cement landing. A more contemporary, and increasingly popular, solution is the use of modular landing and ramp systems, which are now a recognized product solution for ADA compliance per CSI MasterFormat Division ‘Specialties’ 10 74 49. How do past regulations affect ADA compliance today? Before diving into more details on modern access building code regulations it is important to understand how construction practices have evolved. In the past, due to problems with water and moisture penetrating framing, many commercial and residential building entrances were constructed with rises at door thresholds to prevent water damage and flooding. “On-grade concrete floor slab systems in the 1967 Uniform Building Code required exterior lath extensions to extend below the floor line,” says Gene McFarren, an architect in California, “which was before the advent of high-grade sealants”. Thus it’s inevitable that past building requirements and construction practices now conflict with the current 2010 ADA Standards for Accessible Design (2010 ADAS) for existing facilities. As a result, schools and facility owners throughout the country have thousands of door thresholds requiring modification, which entail substantial costs for proper retrofits and remodeling. This is especially true on school campuses with outswinging classroom doors, which are most prevalent in California and the Sunbelt states. What requirements must be met to become ADA compliant? Defined in Figure 1 below is a typical architectural drawing produced for planning and project bidding for a level landing at an existing door threshold. However, the drawing does not represent the actual work product required to make a level-landing compliant. For this example, we are assuming that the substrate out from the door is level, or no greater than 2% slope in any direction with a 1” high threshold. The typical requirement, as in most cases, is a 60” x 60” ‘maneuverable’ level surface adjacent from the ‘strike-side’ of the existing door. This normally consists of a 36” door opening and a 24” ‘strike-side’ clearance, which equals the 60” mentioned above. This is required so that a person in a wheelchair is on a level surface and will not be forced by gravity to roll in any direction while accessing the door hardware, opening the door, or moving into or out of the doorway. These requirements refer to normal door hinge systems that do not have automated operating systems.   Additionally, California is one of the states that requires there to be 42” from the door opening (as opened and perpendicular to the door frame). Thus most landings in California will extend out from the door threshold 72” instead of the typical 60” required by federal standards. While the required “maneuverable level landing” area may differ with various “path of travel” access and door approaches, in most conditions we have found this example representative of industry standards. Two solution options – Concrete Landings or Modular Landings Concrete Landings A traditional approach is to build a concrete landing adjacent to the door threshold. The example below shows the actual work product necessary to make a concrete level-landing compliant. An important factor to consider is that when pouring cement there is the ever-present factor of material slump. This occurs when the material is allowed to flow or slump without any expansion or construction forms, as the surface cannot exceed more than 2% fall in any direction. For simplicity sake this is calculated at no more than ¼” drop in elevation for every linear foot out from the threshold. So for a 1” high door threshold modification on a typical 3/0 door system (36” wide-door), it would require an area of 113 sq. ft. of a new concrete footprint to make this level-landing compliant (See Figure 2). Modular Landings A more contemporary, cost-effective and flexible solution is the application of modular landings. Figure 3 shows the actual work product necessary to achieve compliance. When a molded level-landing is utilized for the same door threshold height of 1” high, the necessary footprint is only 42 sq. ft. outside the door. In every instance, where a landing is constructed, it is required that there be a 1:12 or 8.33% ramp or transition coming off this maneuverable level surface on all three sides. Now consider for a moment that the door threshold is 2” high. The 1:12 requirement means the transitions on all three sides would have to be no less than 1:12 or 8.33%, so a modular landing would require a much smaller footprint than a concrete alternative. Case Study – Mary Helen Rogers Senior Community, San Francisco A recent project in San Francisco, at the Mary Helen Rogers Senior Community encountered this very problem with vertical rises at balcony door thresholds that exceeded federal and state building regulations. Collaborating with HKIT Architects and Cahill Construction SafePath Products, of Chico California, was asked by HKIT Architects of San Francisco, to present a product solution for code compliance at these outswing balcony doors. It was critical not to impede, but rather facilitate the weep channels existing in this door system while providing an attractive “green” solution for this problem. - [Residential Remodeling Index Released – 1Q 2010](https://safepathproducts.com/residential-remodeling-index-released-1q-2010/): The level of remodeling activity nationally reached a bottom in the first quarter of this year, according to the latest release of the Residential Remodeling Index (RRI) by Hanley Wood. The seasonally adjusted first quarter national composite of the RRI declined less than 0.2% from the last quarter of 2009. The RRI forecasts a 1% increase in the second quarter of 2010, the first quarter-over-quarter improvement in two years. The seasonally adjusted index shows the relative level of activity in the geography specified (MSA or national composite) compared to 2007 (the baseline year). The index is produced through a statistical model that leverages detailed data on remodeling activity, including household level remodeling permits, and consumer reported remodeling and replacement projects. Proper installation of raised wood floors, especially in retrofit and replacement projects, can be problematic to flooring contractors when faced with interpreting federal and state ADA (Americans with Disabilities Act) access compliance laws. Vertical Floor Transitions and ADA Compliance Risks Problems occur around the proper treatment of vertical rises from variations of the new flooring material to the existing or old floor substrate. Vertical floor edge treatment is not only required to avoid tripping hazards, but also essential for disabled access code compliance. ADA Flooring Requirements Flooring materials produced today offer models with greater vertical height than those of the past because of high performance demands by the professional sport industry. Imagine, a new floor system that has increased the entire floor height of a gymnasium by two-inches? The change in elevation naturally would affect all access doors. Why Door Entrances Are Affected by Floor Height Changes Traditionally when there were small variations in vertical heights in a new flooring project applying small floor reducers was left to the discretion of the flooring contractor or installer, because these reducers typically didn’t impact the building code, but merely a finishing element of the flooring project. With the increased height for new performance sport floor systems subtly comes with it increased responsibility for design and construction standards for the flooring contractor because federal and state access codes apply. When ADA Access Codes Apply to Flooring Projects Increasingly these ADA flooring requirements and conditions occur in construction of sports facilities, exercise gyms, dance floors, and in sports related exercise rooms. Federal, state and local access code compliance laws require flooring reducers to satisfy something more than just a beveled approach at the ending of a floor edge or at the door entrance threshold. Vertical Rise Limits and Doorway Compliance Vertical rises greater than a ½”, occur with new hardwood flooring materials especially athletic sport floors that commonly exceed ½”. This requirement is not typically demanded for nonpublic use of doors such as janitorial closets or supply rooms. However, every other instance when the vertical rise is greater than a beveled ½”, especially adjacent to an access door entrance is when mistakes are made with ADA flooring requirements. In almost every instance federal ADA and state and local access code laws will apply to the flooring professional whether it is a public or private project or even an exclusive club. Unless it is only involving a private residence, the regulatory standards will undoubtedly impact the project. Why “Grandfathered” Buildings Are Not Exempt ADA flooring requirements often invoke the uninformed phrase, “We are grandfathered in, and therefore the law doesn’t apply to us”. This is never the case, and it doesn’t matter how old the building or facility is, while there may be some extremely limited tolerance exceptions for historical buildings, the obligation to follow model access code laws is never excused. Maneuverable Clearance Areas at Door Thresholds Public door entrances and exists to a new gym floor that has an elevation change, will require a greater universal design than a ramp or reducer to be compliant if greater than a ½”. The requirement at door thresholds is often a level and clear area, referred to as a “maneuverable level clearance area”; one that allows a person to be on a level surface while accessing door systems and door hardware. The reasons for this are simple. When a disabled person is approaching a door entrance and they are on a ramped slope, they have difficulty maneuvering a wheelchair up a slope at the same time accessing hardware and keeping the door open while trying to enter or exit a room or building. Violations of ADA Flooring Requirements Therefore, ramps butting up to door entrances almost always violate access code laws with the exception being an automatic door opening system, a fixed opening or private residence. Failure to follow these disability access laws may subject the owner, tenant, architect, contractor and installer to federal “civil rights” litigation for violations of disability access code laws. Contractor Liability and Civil Rights Litigation When this occurs the contractor is almost always named a party in the pleadings. This type of litigation is often expensive and can occur years after the project has been completed. More shockingly, the person bringing the action does not have to be disabled themselves or have been personally denied access themselves. Common ADA Flooring Mistakes in Sports Floor Projects A typical code violation occurs when a ramp is placed at a door entrance as seen here in fig 1. In this instance vertical edge treatment has not been executed properly; notice there is the absence of a level surface area adjacent the door opening. Alarmingly, this occurs often in hardwood sport floor modernization projects. Which begs the question, why does this occur and why aren’t ADA flooring requirements followed? It is speculated that the interest of installing as much flooring product as possible supersedes the concern for disability access at entrances because it is desirable for the customer and the installer. Absent specialized access compliance training and code interpretation and knowledge, flooring contractors assume the risk for disability access design not contemplated in the contract, but attach the responsibility and liability through their performance. The phrase, “ignorance is no excuse for the law” applies here and pleading ignorance will not save you. An entire volume of federal access code regulations apply to door entrances interpreting door openings and clearance areas with vertical rises greater than ½”. Modified or enhanced codes can incorporate state, local and regulatory agency rulings that may be more restrictive than the federal standards. A large sector of the flooring industry has unwittingly taken on this exposure for complying with disability access laws with all the risk and none of the reward. Compared to rubber threshold ramps, this is especially true when attempting to bring a concrete edge to a thin layer, as when making a ramp. Concrete in thin applications is vulnerable to cracking, even when using plasticizers. Concrete ramps or transitions often have to comply with the American with Disability Act, (ADA) where the edge of any ramp cannot be greater than a vertical ¼”. This is difficult to, especially in retro-fit applications when applying concrete on top of existing concrete, it often results in disaster with cracking and chipping due to expansion and contraction (as can be seen in the picture above). The expense of saw-cutting and abrading is a way of remedying this problem; however, this can be costly and require building permits, setting and removal of forms, and the disposal of materials. A quick and affordable remedy for this problem is to use a recycled rubber finishing edge part for the leading edge of the concrete ramp. Recycled rubber Concrete fix After 545615646511performs well; especially in inclement weather. It also offers a valuable visual cue to the pedestrian that there is an impending rise in the walkway. Moreover, the material properties in recycled rubber provide for an increased and superior Static Coefficient of Friction (SCOF) rating for the surface, which indicates the slipperiness of a particular surface. Recycle rubber ramp products come in various sizes and heights. Rubber ramps or reducers are adhered with high grade silicone adhesive and have a long life cycle. When selecting a recycled rubber ramp product it is important to look for a high durometer rated product, (this indicates the density or hardness of the product). It is also important to specify no silicone on the product, as many manufacturers use silicone or similar product as a mold release agent. This can interfere with proper adhesion of the rubber to the substrate. The use of recycled tires in conjunction with concrete makes for a fast and affordable fix that uses natural recycled resources that otherwise are headed for the landfill. Mr. & Mrs. O’neil adopted him after he had been there about 3+ months recovering. He was nearly blind with cataracts; nearly all of his teeth were severely infected (later pulled by the vet at the animal shelter). He has congestive heart failure and an enlarged heart that presses against his lungs making it hard to breathe (much less run and play) He then had a hernia, which he had fixed with surgery. As Rocky got better and older, it became extremely difficult for him to get in and out of the sliding glass door to take care of “business”; this was due to the slight jump required to get over the slider door rails and rise. So the Oneil’s reached out to us (SafePath Products) for help. We supplied them with ramps to help him get in and out of the sliding doors as well as ramps to help him get into his sleeping crate. Rocky can easily go in and out of the house and his crate, and he is much happier now! A great thank you to the O’neils for their kind hearts and for sharing this story with us.
